Article 2 - GENERAL PROVISIONS RELATING TO THESE GTCS
The present Terms & Conditions («CGV») apply exclusively to the online sale of products offered by the Kanïssia company on the Site.
They are available for consultation on the Site and may be communicated on request.
The Customer acknowledges, by checking the box or clicking on the button provided for this purpose, have read and accepted before confirming the order. Validation of the order implies acceptance of the GCS in force on the day of the order.
Article 3 - DESCRIPTION OF PRODUCTS
The Site offers for sale tights and fashion accessories (hereinafter the «Products»).
Each Product is described in detail, with details of its key features (materials, sizes, colors, etc.). Visit photos are illustrative and non-contractual. The instructions for use or the care instructions, when they constitute an essential element, are shown on the Site. The Products are in compliance with French law in force.
The Customer remains responsible for the modalities and consequences of his access to the Site (Internet access provider, equipment, costs). It is the customer's responsibility to have the appropriate secure, functional configuration.
Article 4 - CUSTOMER AREA
To order, the Customer creates a personal space (login + password strictly personal and confidential). It is solely responsible of the use of its identifiers, unless fraud is proven, and undertakes to inform without delay Kanïssia in the event of loss, misappropriation or fraudulent use.
At the time of registration, the Customer undertakes to :
- Providing information real, accurate, complete and up-to-date,
- Do not use false identities or unauthorized addresses,
- Update information.
The Customer shall refrain from disseminating via the Site any illicit, defamatory, fraudulent or harmful content (viruses, identity theft, etc.). In case of breach, the Kanïssia company can suspend or terminate access, to the exclusive detriment of the Customer.
Registration is personal and cannot be carried out on behalf of a third party without authorization (e.g. a legal entity).
Article 5 - ORDERS
Product offers are valid while stocks last.
In the event of unavailability after confirmation, Kanïssia will inform the Customer and will propose, at the Customer's choice :
- Visit delivery of an equivalent Product (quality/price), or
- Visit reimbursement Product within 30 days maximum.
Excluding reimbursement of the unavailable Product, no cancellation fees is due, except in the event of a fault attributable to Kanïssia.
Order process
The Customer selects his Products, adds them to the basket, checks the details and the total price, corrects if necessary, then valid. Validation is valid acceptance of terms and conditions and contract formation.
A order confirmation (including the number) is sent by e-mail; a digital invoice is available in «My account». Customers are advised to print and/or archive these documents on a reliable and durable medium.
All communications relating to the order are sent to the email address associated with the account.
Modification - Refusal
Any modification after confirmation is subject to agreement of the Kanïssia company.
Kanïssia can refuse/cancel an order for a legitimate reason (non-compliance with the GCS, unpaid invoices, pending litigation, lack of confirmation, etc.).
Visit contracts are archived in accordance with the law and can be transmitted on written request at contact@kanissia.com.
Responsibility & capacity
Information provided (name, address, etc.) engage the Customer; Kanïssia is not responsible for any error preventing/delaying delivery.
The Customer declares that he has legal capacity. Registration is open to major and minors under parental responsibility.
Article 6 - PAYMENT TERMS AND SECURITY
All orders are subject to payment.
Payments are processed via secure solutions: Cawl (credit card), Apple Pay, Google Pay and PayPal.
Payment data do not pass through the Site; they are transmitted via an encrypted connection. TLS/SSL to service providers.
The order is considered effective only after validation by the payment center.
If a debit is not possible (expired card, maximum limit, incorrect data, refusal of authorization), the sale is void.

Article 7 - PRICE PAYMENT
Prices are quoted in euros (€) all taxes included (VAT), excluding delivery charges.

Visit total amount due (Products + delivery) is indicated before validation.
The price is due in full at the time of order confirmation.
Article 8 - FORMATION OF THE CONTRACT
The contract is formed at «double-click» :
- Add to basket and check/correct,
- Acceptance of terms and conditions + payment,
- Final validation.
Double-clicking is equivalent to electronic signature, equivalent to a handwritten signature, and constitutes a irrevocable acceptance of the order.

Customer resolution
The Customer may cancel the contract in the event of :
- Non-compliance of the Product,
- Delay beyond the deadline or, failing that, 30 days after contract conclusion, after formal notice had no effect,
- Price increase not justified by a technical modification imposed by the public authorities.
In these cases, he can obtain reimbursement of the sums paid, plus interest at the legal rate from the date of collection.
Resolution by Kanïssia
Kanïssia may cancel the order in the event of :
- Refusal to accept delivery by the Customer,
- Non-payment total/partial price on delivery.
Article 9 - RESERVATION OF TITLE
Kanïssia retains full ownership products until full payment and effective price, shipping included.
Article 10 - SHIPPING AND DELIVERY
Online sales are reserved for consumers residing in France. France or in the’European Union, with delivery in the same zones.
Visit delivery refers to the transfer of ownership physical or control of the Product.
Delivery methods
In France :
- Colissimo Point Retrait 2 to 4 working days after dispatch (relay).
- Colissimo Standard Domicile (no signature required) 2 to 3 working days after dispatch.
- Chronopost 18 24 h after dispatch, delivery before 6 p.m. (excluding weekends and public holidays).
In the European Union :
- Colissimo International Point Retrait 3 to 5 working days after dispatch (depending on country).
- Colissimo International Domicile (with signature) 3 to 5 working days (depending on country).
- Chronopost Express International 1 to 3 working days after dispatch, delivery before 7 p.m. (depending on country).
Deadlines and costs
Visit delivery charges are indicated at the time of ordering and accepted during validation.
Kanïssia undertakes to deliver within a maximum period of 30 days after receipt of order. Delivery times are given in business days (preparation + dispatch + transport).
In the event of unforeseen circumstances (delay/unavailability), a email informs the customer of a new estimated date.
Address - Reception - Reservations
Delivery to’address indicated by the Customer. The Customer must check accuracy the address; Kanïssia is not responsible for errors preventing/delaying delivery. No delivery at box.
On delivery, a signature may be required; in relay, a identification can be requested.
The Customer must check Product conformity and’integrity of the package. In the event of damage, missing product or damaged parcel, the customer must express specific, reasoned reservations on the delivery slip. By default, In the event of a defect, no subsequent claims regarding quantity/condition will be accepted.
Article 11 - RIGHT OF WITHDRAWAL
The Customer has a 14-day period from reception to exercise its right of withdrawal, without having to justify its decision.

The Customer may also send a unambiguous statement (mail/email) indicating: name, address, telephone, email, order number.
Product returns
Unless otherwise indicated, the return costs are at the customer's expense.
The Product must be returned in its original packaging, in perfect condition, not used, suitable for resale, with all accessories if applicable. The return package contains full contact details of the Customer, the order number and the invoice.
Refund
The Kanïssia company refund the Product amount within 14 days from reception of the Product and the necessary elements. Refunds are made by same means of payment when possible. Orders paid by credit notes/gift certificates may be refunded in the same form, at Kanïssia's discretion.
Article 12 - CUSTOMER SERVICE
The Customer may contact the Kanïssia company :

Article 13 - INTELLECTUAL PROPERTY AND SITE USE LICENSE
The Kanïssia company is the sole owner of all elements of the Site (texts, images, videos, logos, drawings, models, software, trademarks, visual identity, databases, Site structure, etc.) protected by intellectual property law («copyright").« Elements »).
No Element may be modified, reproduced, copied, duplicated, sold, published, communicated, distributed, broadcast, represented, stored, used, rented or exploited, in whole or in part, in any medium whatsoever, without prior written authorization of the Kanïssia company.

Article 14 - LIABILITY AND GUARANTEES

Legal warranties
The Products benefit :
- From the legal warranty of conformity (C. conso., art. L.217-4 et seq.),
- From the warranty against hidden defects (C. civ., art. 1641 et seq.).

- you have a period of 2 years from the date of delivery of the goods ;
- you can choose repair or replacement (art. L.217-9), unless the cost is manifestly disproportionate; ;
- you are exempt from proving the defect during 24 months after delivery (except used goods).

Article 16 - AFTER-SALES SERVICE
